Terms of Use
These Terms of Use govern the use of the Ground Hoppers App (iOS, Android, Web) and the associated website ground-hoppers.app (hereinafter collectively referred to as “the service”). By registering or using the service, you agree to these terms. Please read them carefully.

1. Use of the Service
You may only use Ground Hoppers App in compliance with applicable laws and these Terms of Use. You must be at least 16 years old to use the service. By registering, you confirm that you are at least 16 years old. If you are between 16 and 18 years old, you confirm that you have your parent or guardian's consent to use the service.
2. Accounts and Registration
An account is required to use most features. You can register with email and password, via Apple, or via Google. You are required to provide truthful information during registration. You are responsible for your account credentials and all activities carried out through your account. You may not transfer or share your account with third parties. In the event of unauthorized use or suspected security breaches, please inform us immediately at contact@ground-hoppers.app. You may only create one account per person.
3. User Content
You may not upload or share unlawful, abusive, offensive, discriminatory, infringing, glorifying violence, pornographic, threatening, or otherwise harmful content. In particular, you may not upload content that infringes third-party rights (copyrights, trademark rights, personality rights). You retain ownership of your content. By uploading content, you grant Ground Hoppers App a non-exclusive, worldwide, royalty-free, sublicensable license to display, store, and technically process your content within the scope of the service (e.g. resizing images). This license serves solely to provide the service and expires when you delete the respective content or delete your account. We reserve the right to remove content that violates these Terms of Use or applicable law without prior notice.
4. Rules of Conduct
When using the service, it is prohibited to: Harass, threaten, or discriminate against other users. Send spam, chain letters, or unsolicited bulk messages. Pretend to be someone else or use false identities. Disrupt, overload, or manipulate the technical infrastructure of the service. Use automated access (bots, scrapers, crawlers) without our express consent. Circumvent or manipulate security mechanisms of the service. Use the service for commercial purposes unless expressly authorized by us.
5. Premium Subscriptions
Ground Hoppers App offers a free basic plan and a paid premium subscription. Premium subscriptions are billed exclusively via the Apple App Store or Google Play. The respective payment terms of Apple or Google apply. Subscriptions renew automatically for the respective period (monthly or yearly) unless canceled at least 24 hours before the end of the current billing period. Cancellation is done via the Apple App Store or Google Play in your device's subscription settings. Refunds are handled by Apple or Google according to their own policies. Ground Hoppers App has no influence over refund decisions. Current prices can be found on our website and in the app stores. We reserve the right to change prices. Changes will be announced at least 30 days in advance and will only apply from the next renewal period.
6. Intellectual Property
All rights to the Ground Hoppers App, including design, logo, texts, software, graphics, and other content (except user content), are owned by Ground Hoppers App or its licensors. Use of the service does not grant you ownership rights to the service's intellectual property. You may not copy, modify, distribute, sell, or decompile the app, its source code, or parts of it.
7. Availability of the Service
We strive to provide the service as continuously as possible, but do not guarantee uninterrupted availability. Temporary limitations may occur, for example due to maintenance work, technical disruptions, or force majeure. We reserve the right to change, restrict, or discontinue the service or individual features at any time.
8. Liability
We are liable without limitation for intent and gross negligence as well as for damages resulting from injury to life, body, or health. In cases of slight negligence, we are only liable for breaches of essential contractual obligations (cardinal obligations), and even then only limited to the foreseeable damage typical for the contract. We are not responsible for user-generated content. We are not liable for damages arising from the use of external links or third-party services. The limitations of liability do not apply where we have expressly assumed a guarantee or where mandatory statutory provisions prevent such limitation.
9. Termination and Account Suspension
You can delete your account at any time in the app settings. Deletion becomes effective within 30 days. We reserve the right to temporarily suspend or permanently delete accounts if: You violate these Terms of Use. You use the service in a way that harms other users. You use the service for unlawful purposes. Your account has been inactive for more than 24 months. If we suspend or delete your account, you will be informed. In the case of an active premium subscription, canceling the subscription via the App Store or Google Play is required separately.
10. Dispute Resolution
The European Commission provides a platform for online dispute resolution (ODR): https://ec.europa.eu/consumers/odr. We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
11. Severability Clause
Should any provision of these Terms of Use be or become invalid or unenforceable, this shall not affect the validity of the remaining provisions. The invalid provision shall be replaced by the valid provision that comes closest to the economic purpose of the invalid provision.
12. Changes to the Terms of Use
We may update these Terms of Use from time to time. We will inform you of material changes at least 30 days in advance via push notification or email. If you continue to use the service after the changes take effect, you agree to the updated terms. If you do not agree with the changes, you may delete your account before the changes take effect.
13. Applicable Law and Jurisdiction
These Terms of Use are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods. For disputes with consumers, the mandatory consumer protection provisions of the state in which the consumer has their habitual residence apply. The place of jurisdiction for disputes with merchants is the provider's registered seat.
